Celebrating Justice: Atabek & Co. Secures Jury Trial Victory Against CVS

Atabek & Co. proudly announces its victory in a recent jury trial against CVS! Representing a disabled individual, Jon Atabek and Hellay Taherian of Atabek & Co. navigated a complex legal battle against the retail giant, ultimately securing a verdict that underscores the importance of upholding the rights of all individuals, regardless of ability.

The case centered around an incident in which our client, a disabled person, suffered a fall while exiting a CVS store in his wheel chair. The root cause of the accident was identified as a non-compliant tile, which violated provisions of the Americans with Disabilities Act (ADA) and the California Building Code. Despite CVS initially admitting to the non-compliance of the tile, they later attempted to backtrack on their admission, challenging the specifics and casting doubt on the sequence of events leading to our client’s fall.

Throughout the trial, CVS employed a myriad of tactics to deflect accountability, including disputing our client’s disability status and accusing him of falsifying the incident—though CVS later conceded our client is disabled, but only after they realized how ridiculous they would look in challenging it. They challenged the testimony of witnesses and attempted to shift blame onto our client for choosing to navigate his wheelchair independently on the day of the incident, calling into question a disabled person’s right to want to be independent. Despite CVS’s relentless efforts to muddy the waters and confuse the jury with tired trial attorney tactics, our legal team remained steadfast in presenting the facts and advocating for our client’s rights.

The jury saw through CVS’s attempts to obfuscate the truth and delivered a resounding verdict in favor of our client. Their decision not only vindicates the rights of individuals with disabilities but also serves as a powerful reminder of the importance of accessibility and inclusion in public spaces.
